TENANT EVICTIONS
The firm primarily represents landlords, but also tenants, in residential and commercial tenant eviction matters and landlord tenant disputes.
In a residential tenant eviction case, the eviction process is governed by the Florida Residential Landlord and Tenant Act, Chapter 83, Part II, of the Florida Statutes. Strict compliance with the Act is necessary for a landlord to successfully prosecute a tenant eviction action. Therefore, residential landlords should consult with an attorney both before the lease is signed and before litigation commences to avoid delays and unnecessary expenses, including having to pay the tenant’s attorney’s fees for improper filing.
Commercial tenant eviction actions are governed by Chapter 83, Part I, of the Florida Statutes entitled Non-Residential Tenancies, but the parties’ duties and obligations in a commercial landlord tenant case are based primarily on the contractual terms of the lease between the parties. Since commercial lease terms vary significantly, it is necessary for a qualified attorney to review the lease and carefully guide the parties through any litigation.
